These Terms of Use govern your use of the Food Delivery Pros website, courses, tools, downloads, and other digital materials. By accessing or purchasing Food Delivery Pros products, you agree to these Terms. If you do not agree, do not use or purchase the applicable products or services. Food Delivery Pros is operated by Matthew Stillwell, a sole proprietor doing business as Food Delivery Pros.
1. Educational Products Only
Food Delivery Pros provides educational and informational training for independent delivery drivers and others interested in app-based delivery work.
Food Delivery Pros does not provide:
- employment;
- delivery jobs;
- customers;
- delivery territories;
- platform accounts;
- guaranteed access to delivery platforms; or
- an income or business opportunity.
You are responsible for creating and maintaining your own relationships with any delivery platforms you choose to use.
2. No Earnings or Results Guarantee
Food Delivery Pros does not promise or guarantee any particular earnings, income, tips, order volume, hourly rate, profitability, or other result.
When historical earnings, delivery statistics, time estimates, or other performance figures are discussed, they describe the author’s own historical experience or are illustrative examples used to explain a method. They are not representations of typical results, forecasts, or promises about what another person will earn.
Results vary based on factors including market, platform demand, location, schedule, vehicle and operating costs, experience, individual decisions, customer demand, platform policies, and other conditions outside Food Delivery Pros’ control.
3. No Professional Advice
Food Delivery Pros does not provide individualized legal, tax, financial, accounting, employment, insurance, or other professional advice. Information about taxes, expenses, recordkeeping, mileage, regulations, or related subjects is educational only. Consult an appropriately qualified professional about your individual circumstances.
4. Platform Independence
Food Delivery Pros is an independent educational business. It is not affiliated with, endorsed by, sponsored by, or operated by Uber, Uber Eats, DoorDash, Instacart, Grubhub, Shipt, Walmart Spark, or any other delivery platform, retailer, restaurant, or company mentioned in our materials unless expressly stated otherwise.
Third-party company names, logos, and trademarks belong to their respective owners.
5. Changing Platform Rules and Laws
Delivery platforms change their rules, features, programs, eligibility requirements, pricing, metrics, and procedures. Laws and local regulations also change.
You are responsible for following the current:
- platform rules and agreements that apply to you;
- traffic and parking laws;
- alcohol and restricted-delivery laws;
- store and property rules; and
- other applicable federal, state, and local laws.
If current law or a platform’s current requirements conflict with something in our educational materials, follow the applicable law and current platform requirements.
6. Purchases and Payment Options
Food Delivery Pros may offer products through a one-time payment or a fixed installment/payment plan. The total purchase price, payment option, number of installments, and applicable payment schedule will be shown before purchase.
A fixed installment plan is a method of paying for a purchase over time. It is not an automatically renewing membership or subscription unless the checkout page expressly says otherwise.
By selecting a payment plan, you agree to complete the scheduled payments. If a scheduled payment fails, access may be temporarily suspended until the outstanding payment is successfully completed, subject to applicable law and payment-processor requirements.
Food Delivery Pros may change prices for future purchases. A later price change does not alter a completed purchase.
7. Refunds and Digital Access
Purchases are governed by the Food Delivery Pros Refund & Digital Access Policy, which is incorporated into these Terms by reference.
Except where required by applicable law, all sales are final. Because our products are digital and access is provided immediately after purchase, refunds are not available once access has been granted.
8. Ongoing Access
Your purchase provides ongoing access to the purchased product or bundle while Food Delivery Pros continues to offer and support that purchased version.
Major future editions, newly created products, or separately sold products are not automatically included unless expressly stated.
If a purchased product is permanently discontinued, Food Delivery Pros will make reasonable efforts to provide notice and, where practical, an opportunity to download materials that we are able to provide for personal use.
9. Personal-Use License
When you purchase or otherwise receive Food Delivery Pros materials, you receive a limited, personal, non-exclusive, non-transferable license to use those materials for your own educational purposes. You do not acquire ownership of the underlying intellectual property.
10. Prohibited Uses
Unless Food Delivery Pros gives prior written permission, you may not:
- resell our materials;
- redistribute them to others;
- share paid account credentials;
- publish or upload paid materials publicly;
- commercially reproduce course materials;
- copy or distribute substantial portions of the content;
- remove copyright, trademark, or other ownership notices;
- use our materials to create or sell a competing copy or substantially derivative product;
- bypass access restrictions or technological controls; or
- otherwise exploit the materials outside the personal-use license granted above.
11. Intellectual Property
Food Delivery Pros retains its rights in original materials including:
- course text;
- educational frameworks;
- graphics;
- worksheets;
- downloadable materials;
- videos;
- written resources;
- website content; and
- Food Delivery Pros branding.
Third-party trademarks and other third-party intellectual property remain the property of their respective owners.
12. Account Security
If your purchase includes an individual account or login, you are responsible for maintaining the confidentiality of your login credentials. Do not share paid account access with others. Contact [email protected] if you believe your account has been compromised.
13. Third-Party Services and Links
Food Delivery Pros materials may reference or link to delivery platforms, retailers, restaurants, mileage applications, software providers, websites, or other third parties.
Food Delivery Pros does not control third-party services and does not guarantee their continued availability, accuracy, pricing, policies, performance, or practices.
Your use of third-party products or services is governed by their own terms and policies.
14. Suspension or Termination
Food Delivery Pros may suspend or terminate access when reasonably necessary because of fraud, unauthorized account sharing, resale, redistribution, infringement, payment failure, or a material violation of these Terms.
Termination does not eliminate obligations that arose before termination, including payment obligations under an agreed payment plan where legally enforceable.
15. Disclaimer of Warranties
To the extent permitted by applicable law, Food Delivery Pros materials and website services are provided for educational and informational purposes without warranties that they will be uninterrupted, error-free, continuously available, or suitable for every person’s individual circumstances.
We make reasonable efforts to maintain accurate and useful materials, but delivery markets, platforms, businesses, roads, laws, pricing, technology, and other conditions can change.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Food Delivery Pros will not be liable for indirect, incidental, special, consequential, or similar losses arising from the use of or reliance on our educational materials, website, or third-party services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
You remain responsible for your own driving, purchasing, financial, tax, legal, platform, safety, and business decisions.
17. Changes to Products and Terms
Food Delivery Pros may update courses, website content, and these Terms as products, technology, laws, and business practices change.
When these Terms are revised, the updated version will be posted with a new “Last Updated” date. Where appropriate or legally required, additional notice of material changes may be provided.
18. Governing Law
These Terms are governed by the laws of the State of California, subject to applicable federal law and any mandatory consumer protections that cannot lawfully be waived.
19. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
20. Entire Agreement
These Terms, together with policies expressly incorporated by reference, constitute the agreement governing your use of Food Delivery Pros products and services regarding the subjects they address.
21. No Waiver
A failure to enforce a provision of these Terms in one instance does not waive the right to enforce that provision in the future.
